The case needs sufficient reliable evidence of the applicable requirements, not necessarily every document ever held by one provider. Identify what is missing and whether other proper records establish the relevant facts. Do not assume that a missing archive is either harmless or automatically fatal without assessing the specific gap.
Make an evidence map
List ownership, operations, employment and duties separately and identify available support for each. Ask the responsible adviser what additional evidence is required. An unsupported statement should not be treated as a substitute simply because the original record is inconvenient to obtain.
Four questions decide L-1A eligibility, and weakness in one is not cured by strength in another.
Is there a qualifying relationship? The foreign employer and the US entity must stand as parent and subsidiary, as branch, or as affiliates under common control, and both must actually be doing business — an entity that exists on paper while trading nothing does not qualify, however tidy its incorporation documents look.
Has the applicant completed the qualifying year? One continuous year of full-time employment with a qualifying entity abroad, falling within the three years before the petition is filed, is the test. Continuous means continuous: a year assembled from scattered months does not count, and time already spent working inside the United States does not fill it.
Are the duties primarily managerial or executive? Direction of the organisation, of a department or function, or of professional subordinates, with real discretion over day-to-day operations, is what the category means. Performing a valuable function personally, however skilled the performance, is not management — and that distinction is where most refusals sit.
Is there room on the clock? L-1A status is capped at seven years in total, and time already used counts against it.
Hypothetical example: a theatre automation director supervised a four-person rigging crew abroad and is proposed as a US operations manager. The file has to show whether those subordinates were professionals with their own credentials or hands-on technicians, because that fact — not the title on the offer — decides whether the personnel-management route is open or whether the case has to rest instead on management of an essential function. It does not by itself point to L-1B, which turns on the separate test of special or advanced knowledge of the employer's own product, process or procedures.
