Somebody drawing a salary — in marine electronics, on a terminal, at a ferry operator, in a community services agency — is asking an employment question, and it is answered by citizenship, by a listed profession's own qualification rule, and by three years of duties described honestly. Somebody who owns a repair yard, a dredging contractor or a bunkering business, and wants an American counterpart to it, is asking an ownership question, answered instead by control, by capital genuinely exposed to loss, and by a traceable history for every dollar.

Separate the person from the position

Every employment route makes two findings that can fail independently of each other. On one line, record what qualifies you: the citizenship a passport shows, degrees, licences, years of documented practice. On another, record what the American role would actually consist of, week by week, in activities rather than in a job title. Well-qualified applicants are refused far more often over the second line than the first.

Draw the ownership as a registry would show it

Where companies sit on both sides of the border, sketch the shareholding with percentages, dates and legal names. Long trading history, shared branding and family connection count for nothing by themselves. A transfer route needs a parent, branch, subsidiary or affiliate relationship that corporate records can demonstrate; an investment route needs nationality and control tests met on exactly those numbers.

Trace money backwards from the account it sits in today

Capital is judged by its history rather than by its size. Follow each amount from where it now rests, through every transfer, back to whatever generated it: a sale, an estate, a mortgage advance, retained earnings taxed years ago. A break in that chain sinks more investment applications than any doubt about the business being bought, and closing the gap is far cheaper before the money moves than afterwards.

Bring the unresolved points, not the whole story

A first remote consultation is most useful when it covers three or four things you could not settle on your own. It should finish as instructions: which letter needs redrafting, which registry extract to order, which corporate step has to happen before a filing is made, and whether another member of the household changes the order of events. Where a formal filing follows, a licensed U.S. immigration attorney takes carriage of it.

A FEW THINGS UP.

I have thirty years at sea and a master mariner's certificate. Is there a TN category for that?

TN reaches only the professions listed in USMCA Appendix 2, and a certificate of competency, however senior, is not one of them. The listed professions nearest to marine work are Engineer, Land Surveyor and the scientist entries, each carrying its own degree or licence requirement rather than a sea-time requirement. Someone whose qualification is a ticket rather than a baccalaureate or a professional licence usually has to look instead at a transfer through an employer with a qualifying American entity, or at owning something across the border.

Our transport economist has been offered work with an American port operator. Is Economist genuinely on the list?

It is. Economist appears in Appendix 2 and is satisfied by a baccalaureate or licenciatura degree. The difficulty normally lies in the other half of the test, which asks whether the American position consists of economic work at all. Forecasting, modelling and published analysis read as the profession; a role that is in substance business analysis, data analysis or commercial management does not, and neither of those appears on the list. Ask the employer to describe the week by activity rather than by internal job title.

We would fund an American purchase by mortgaging our house here. Does borrowed money count?

It can, and what secures the loan is the deciding detail. For E-2 the funds must be irrevocably committed and genuinely at risk, so borrowing against your own personal assets is ordinarily acceptable while a loan secured by the assets of the American business itself is not, because the exposure has been moved off the investor. EB-5 scrutinises the lawful source and path of borrowed capital exactly as closely as of savings. Either way, keep the mortgage instrument, the advance and every transfer afterwards.

Can we meet somebody in Richmond County to go through this?
