State its date and basis accurately and distinguish a current explanation from a contemporaneous record. Later evidence can provide context, but it should not be backdated or represented as an original document. The record must support the actual ownership or employment facts being claimed.

Preserve provenance

Identify who prepared the explanation, what records they relied on and any limits in their knowledge. Use corroboration where available. A newly prepared chart can clarify history without pretending that it existed at the time of the underlying transaction.

Each eligibility fact has a natural document, and substitutions are what attract questions.

The qualifying relationship — parent, branch, subsidiary or affiliate — is carried by share registers, articles and share certificates, by the instruments that transferred the shares, and by audited statements or regulatory filings showing that both entities are trading. A consolidated group chart is a reading aid, never the proof.

The continuous year of qualifying employment abroad, completed within the three years before filing, is carried by payroll records, tax slips, pension or social-insurance contributions and dated employment contracts. These are the strongest exhibits precisely because a third party generated them at the time and had no stake in this petition.

The managerial or executive character of the duties is carried by an organisational chart naming subordinates with their own titles and qualifications, by a written job description, and by evidence of decisions actually taken — approved budgets, signing authorities, hiring and dismissal records. The proposed US role needs the same treatment as the foreign one.

Remaining time under the seven-year L-1A ceiling is carried by prior approval notices and I-94 records.

Where an original is genuinely gone, say so: name who prepared the replacement, from which records, and on what date. A statement written this year about a transaction from years ago is legitimate context; presenting it as a contemporaneous record is not.

Hypothetical example: a paper-mill executive’s share transfer predates the current registrar. The registrar can certify the register as it stands today and the former auditor can confirm what the accounts showed — two limited documents that together do the work of the missing one.
