Compare the evidence gaps in a transfer and an acquisition

THE SHORT ANSWER

An applicant may be choosing between a related-company transfer and buying a US business. Both options can involve missing records, but the records serve different requirements. Identify which facts support each route before deciding that one is easier because its document list looks shorter. Hypothetical example: a seafood cold-chain manager can either transfer to a related U.S. company or buy a separate warehouse business. The decision requires two evidence maps: L-1 relationship, active entities, foreign employment, and role; versus E-2 treaty nationality, ownership, irrevocably committed at-risk capital, real operations, nonmarginality, and investor control.

For L-1, establish the organization and employment

Hypothetical example: a Cape Breton Regional Municipality applicant compares a related-company transfer with buying an unrelated U.S. business while records remain incomplete. Review corporate ties, qualifying foreign employment and the relevant managerial, executive or specialized-knowledge duties. Records held by a former provider should be assessed for the fact they prove. An unsupported ownership chart is not a complete relationship record. For E-2, establish the transaction and enterprise

For E-2, establish treaty-country nationality for the investor and qualifying treaty ownership of the enterprise; Canada qualifies. The funds must be lawfully sourced, irrevocably committed and at risk, and substantial relative to the business. The investor must develop and direct a real, operating, non-marginal enterprise, ordinarily through at least 50% ownership or operational control. Seller statements do not replace these requirements. Compare the intended activity and household plan

Identify who will work, when authorization is needed and which commercial obligations arise first. Spouse and child status requires separate review. Neither temporary route automatically determines permanent-residence eligibility. L-1 also requires one continuous qualifying year abroad within the prior three years, a parent, branch, subsidiary or affiliate relationship with both entities active, and is capped at seven years for L-1A or five for L-1B; an unaffiliated-client placement cannot be labour-for-hire and remains under petitioner control. E-2 funds must be irrevocably committed, substantial relative to the business, and at risk, and E-2 has no direct path to permanent residence.
