L-1A is for a qualifying organization transferring an executive or manager to a related US organization. The applicant must normally have worked abroad for the qualifying organization for twelve uninterrupted months during the three years immediately before the filing or admission period. The foreign and US entities must have the required corporate relationship, and the proposed US role must be genuinely managerial or executive. L-1A has a seven-year maximum period of stay. A new US office requires additional proof about premises, business plan, capitalization, organizational development, and the ability to support a managerial or executive position within one year. The transfer should be examined as an organizational decision, not as a reward for a trusted senior employee. Board material, ownership records, budgets, personnel plans, and reporting structures can explain different parts of the case. A small company is not automatically excluded, but its evidence must still show a role that is managerial or executive in substance. When responsibilities are changing, record both the present position and the planned US position with their effective dates. That precision is particularly important where the same person has been doing strategic and operational work abroad. Reviewing the foreign and US positions side by side can expose a title mismatch early. The organization should be able to explain its structure in ordinary business terms, with records that do not depend on hindsight. That is more persuasive than an organizational chart created only for the immigration file. Before filing, the company should identify the officer who can attest to ownership, foreign employment, and the proposed US authority. That officer needs access to the underlying business records. A letter that repeats conclusions without the company’s own documents is less useful than a clear account supported by routine corporate materials. Hypothetical example: A wholesale medical-supply distributor plans to send its foreign regional director to build a U.S. purchasing division. The director currently negotiates supplier terms but also personally processes most orders. The company must decide whether its documented first-year staffing will move routine ordering below the proposed manager, because a senior label cannot carry the role by itself. A first review should yield an entity map, an employment timeline, and a duty allocation showing who will make strategic decisions and who will perform daily tasks.

Prove the corporate connection

Map ownership and control across the foreign and US organizations using formation documents, share records, annual filings, and organizational charts. Labels such as ‘partner company’ are not enough. The record must show a qualifying parent, branch, subsidiary, or affiliate relationship on the relevant dates. Identify the precise ownership date for every link in the chain, especially after a reorganization or capital raise. A corporate registry extract settles a point that a presentation slide may leave unclear.

Describe management at the right level

A manager supervises and controls an organization, department, function, or component at a qualifying level; an executive directs major goals and policies with broad discretion. A senior title does not substitute for evidence of authority, reporting lines, budgets, staffing, and decision-making. Describe which employees or functions will be managed, their level of discretion, and the transferee’s authority over goals or budgets. Ask instead whether the role is primarily leadership rather than a mixed working-supervisor position.

Account for the foreign position

Use payroll, contracts, tax or employment records, reporting structures, and detailed duties to establish the required continuous overseas employment. The file should show what the transferee actually did, not merely the title printed on a business card. Put the twelve uninterrupted overseas months on a dated timeline and test any leave, payroll interruption, or change of employing entity. The relevant period must sit in the 36 months immediately preceding the petition or requested admission.

Treat a new office as its own evidence exercise

For a new office, secure premises and describe the first-year operating plan, financing, hiring, and market activity. The early assignment may involve hands-on work, but the organization must show it will support a qualifying managerial or executive role after the first year. For a developing operation, collect a month-by-month hiring and revenue plan tied to actual funding and premises. A new-office authorization does not erase the need to show a qualifying role after its first year.
