THE SHORT ANSWER

A new-office L case requires more than an entity registration. The organization must show qualifying relationship, premises, a credible operating plan, and the ability to support the intended role after the first year. New-office preparation benefits from a monthly evidence folder. Save executed leases, entity records, funding movements, hiring steps, customer activity, and updated organization charts as events occur. That practice supports an accurate first-year account and discourages backfilling a narrative after the fact. It also makes clear whether the manager, executive, or specialized-knowledge employee is moving into the role the organization said it would create. The plan should answer practical questions: what will the office sell or deliver, who will perform daily operations, who will supervise them, and what evidence will exist as each milestone is reached. A forecast can be credible without being a guarantee. Mark planned hires, estimated revenue, and possible customers as projections. The responsible company officer should be able to explain the plan and recognize the documents that support it. This is especially important where the transferred person has historically performed many hands-on functions in the foreign business. If the company’s plan changes materially, revise the file honestly and collect new supporting records. The eventual record should reflect the enterprise that is actually being established, not a static draft prepared before commercial decisions evolved. The file will be stronger if routine business records, rather than documents created only for immigration purposes, demonstrate that the stated plan is being put into effect. Retaining these ordinary records from the first month can reduce later uncertainty about whether projected operations and staffing became real in the expected period. Date every milestone and retain its original supporting record. Hypothetical example: A cross-border commercial-drone mapping company leases a small U.S. workspace and wants to transfer its operations director before its first local hires begin. The company must decide whether its staffing calendar shows the director moving toward a qualifying management role or remaining the sole field operator. Opening review records a dated premises record, ownership chart, funding schedule, operating milestones, and an accountable explanation of who will perform each function.

Establish the organizations first

Document the foreign entity and the US parent, branch, subsidiary, or affiliate with ownership and control records. Reconcile legal names and dates. A business relationship described informally by founders does not replace the required corporate evidence. Use the same legal entity names in formation papers, ownership exhibits, payroll records, and the business plan. A name mismatch is often a document-control problem that can be resolved before it becomes a relationship problem.

Show that the office is real

Secure physical premises appropriate to the plan and preserve the lease or comparable occupancy record. Pair it with funding, formation, market work, contracts where available, and a detailed first-year operating plan. Avoid representing a proposed hire or sale as already completed. Tie the space to the activities planned there and retain proof of possession rather than a prospectus or unsigned proposal. Test whether the secured premises fit the operation described in the evidence.

Explain the role at year one

For L-1A, show how the office will support managerial or executive responsibilities within one year. For L-1B, explain why the organization will need and support the specialized-knowledge role. Track staffing and operations from launch so follow-up evidence is not dependent on memory. For either L category, track the transferee’s qualifying overseas year in the relevant three-year window and apply the statutory limits: L-1A has a seven-year maximum and L-1B a five-year maximum. The first-year plan must still show the office can support the claimed role.
