THE SHORT ANSWER

A TN file is strongest when the occupation, applicant qualification, employer relationship, and proposed temporary work are each proven by records that speak directly to the point. Before finalizing the file, make a one-page index that identifies the occupation rule, employer letter, qualification record, licence evidence, and citizenship document. Read it against the actual work plan. If a record is conditional or incomplete, say so; conditional business plans should not be presented as final employment facts. This index also helps identify whether a later change would affect the original analysis. Use the final index as a quality-control tool. It should state whether every claim has a primary record, a reliable explanatory record, or an unresolved gap. Check the proposed role once more against the actual tasks and the relevant profession description. A cleaner file does not improve a weak factual fit, but it makes an honest assessment possible. Keep copies of the final employer letter and all records used to support it, because a later work change may need to be compared with the original account. If the worksite, employer, supervision, professional duties, or required credential changes, compare the new facts with the indexed evidence before proceeding. A tidy folder should support that comparison rather than create a false impression that every future arrangement is already covered. Ask the employer to review the final factual description for accuracy before it is used. A correction made early is easier to explain than a mismatch discovered after travel planning has already begun. The index is also a practical handoff tool for a remote consultation: it tells the reviewer what is original, what is a translation, and what still needs confirmation from the employer. Hypothetical example: A Mexican landscape architect receives an offer that calls the job ‘project lead,’ while the signed scope describes design drawings, site plans, and consultant coordination. The applicant must decide whether the employer letter will use the actual professional duties and whether the qualification document matches the selected occupation. The opening review yields a page-by-page list showing which record settles citizenship, employment, credential, and any practice requirement; an unsupported title should not decide the case.

Start with the employer’s current need

Ask for duties, reporting relationship, compensation, work location, and expected period from the actual US employer. Match those facts to a listed USMCA profession rather than selecting a category first and retrofitting the role. A client engagement can support context but does not replace an employer explanation. Name the employer representative who can confirm the duties if an inspector asks a practical question. A job posting may be useful context, but the signed letter and current work plan carry the factual description.

Put credentials beside the rule

Read the qualification line for the selected profession, then assemble the degree, licence, diploma, experience, or evaluation it calls for. Keep name-change records and accurate translations with the credential. Do not assume every degree or long career has the same effect under every occupation entry. Where an evaluation is used, compare its conclusion to the exact qualification rule instead of treating the word ‘equivalent’ as the end of the inquiry. Keep the underlying diploma and transcript with it.

Review the relationship and procedure

Explain who employs and supervises the applicant, particularly where consulting or ownership is involved. A controlled US enterprise may raise a self-employment issue. Canadian applicants should check the appropriate admission or USCIS procedure with current source material and carry the evidence that procedure requires. Choose the procedure only after the employment structure is settled. TN fits prearranged professional services for a separate U.S. employer; self-directed domestic activity lies outside that classification.
