Do not rely on the commercial renewal alone. Assess the actual status and any applicable filing or authorization rules before continuing employment beyond the permitted period. A pending preparation task or employer assurance does not establish permission. Obtain advice on the specific procedure in time to act.
Use the immigration date as a separate deadline
Check the relevant documents and identify the facts needed for any further request. Explain changes in duties or entity at the same time. Do not assume a later-issued contract retroactively cures an authorization gap.
Two clocks run at once and they are not synchronised. The commercial clock is the contract — its start date, its renewal option, the client’s schedule. The immigration clock is the period an officer admits the applicant for, recorded on the Form I-94, and only that second date governs how long employment may lawfully continue. A contract running past the admission period does not extend it, and a renewal signed on the final day authorises nothing by itself.
Sequence the steps against the second clock. The credential, and the licence where the listed profession requires one, must exist before the request is made rather than after; a pending evaluation cannot be offered as a completed one. With those in hand, a Canadian citizen may seek the classification at a port of entry or preclearance and is generally decided the same day, receiving no visa stamp, while a Mexican citizen applies for a TN visa at a consulate first. The employer may instead file Form I-129 with USCIS, which takes as long as the caseload takes. Those routes differ in speed, which is why the choice belongs in the schedule and not in a footnote.
Hypothetical example: a forest mensuration specialist is admitted for a period ending in March while the survey season runs to July. The extension request — and the employer letter explaining the continuing duties for a US employer rather than a venture the applicant controls — belongs in the winter, not the week before.
Leaving and re-entering is not a general substitute for an extension. Diarise the admitted-until date and work backwards from it.
