Does a possible project renewal make a TN offer unacceptable for a Cape Breton Regional Municipality applicant?

THE DIRECT ANSWER

Assess the actual proposed employment and temporary-stay requirements on the full facts. A possible renewal should not be presented as guaranteed authorization, but its existence does not by itself answer every eligibility question. The employer should explain the present role and period accurately.

Separate the current agreement from future options

Identify what has been signed and what remains contingent. Describe the duties and employer rather than relying only on the client project’s label. Any later request must be assessed using the facts and requirements then applicable; a contract option is not an immigration decision.

Eligibility is decided element by element, and a renewal clause is not one of those elements. Citizenship comes first: the category is open only to citizens of Canada or Mexico, and a Canadian permanent resident card cannot stand in for citizenship. The job comes second, because the position must correspond to a profession named in the USMCA professional appendix; an inventive job title on an offer letter settles nothing until the duties are matched against a listed occupation. Third is the credential standard attached to that specific profession, which the appendix fixes for the occupation rather than for the individual. Fourth, the work must be performed for a United States employer, or for an entity contracting for the applicant’s services, so any shareholding in the hiring company should be disclosed and examined early — running a US business the applicant controls falls outside the category altogether.

Hypothetical example: an offer letter names the position forensic illustrator, a title that appears nowhere in the appendix. The honest analysis asks whether the duties are those of the listed Graphic Designer occupation, and whether the applicant holds that profession’s baccalaureate or the post-secondary diploma plus experience the appendix accepts in its place. If neither is true, the answer is that this route does not apply — not that the letter should be reworded.

Canadian citizens present the case for inspection at a port of entry or a preclearance facility and receive no visa stamp; alternatively the employer files Form I-129 with USCIS. The officer decides on the four elements above, so settle them before a start date is promised to anyone.
