Assess what the applicable filing requires and whether the available evidence supports a proper submission. A commercial deadline does not authorize an incomplete or misleading account. Do not state that missing tax or banking records have been reviewed when they have not.
Compare the real deadlines
Identify the project’s contractual date and the immigration requirements separately. Seek instructions or advice about the actual options without assuming an enquiry extends either deadline. Funding availability and a reservation should not be mistaken for a completed lawful-source record.
Several clocks run at once and only one belongs to the project. The immigrant petition is decided on the record filed with it, so a gap in the lawful source and path evidence draws a request for evidence with its own response date, which lengthens the case rather than shortening it. Behind approval sits visa availability, turning on the applicable category, any reserved allocation and the country of chargeability. The capital has to be at risk in the enterprise across that whole span, and the ten full-time positions for qualifying U.S. workers are measured over the project's own timetable, not the filing date. After admission comes a fixed two-year term of conditional permanent residence, with the petition to remove conditions falling in the ninety-day window that ends on its second anniversary — a genuine deadline that cannot be renegotiated. A sponsor's subscription date usually can be.
Hypothetical example: A medical-packaging investor is told a project allocation closes at quarter end, while an overseas bank has not yet released archived transfer records for a share sale. Filing early preserves nothing: the case still turns on the same missing documents, and the file now also carries an account of the funds that cannot be supported. Asking the sponsor whether the allocation can be held, or whether a later closing exists, tests a date that may move. Saying records have been reviewed when they have not is the one option that damages the case permanently.
